On the encouragement of sterilization
The attention of the buyer is drawn to the need to sterilize his cat to avoid possible nuisances related to heat in the female or markings in the male as well as an unwanted projection in the exceptional case of an unattended free-riding which is strongly discouraged for this type of breed.
In the event that the buyer decides not to sterilize his kitten to reproduce it, he is attracted to his
attention to the existence of the ordinance of October 7, 2015 of the Ministry of Agriculture clearly specifying that all sellers of a LOOF domestic animal from a litter that it has given birth, must be in possession of a number of siren registered in an agricultural chamber or for a maximum of one litter per year, must first obtain a litter number issued by the LOOF which it will indicate in all sales advertisements. Failure to own it is punishable by a fine of € 7,500! It is also not possible for an individual to sell non-LOOF pets.
On guarantees
The laws in force which are constantly evolving, protect and rightly the interests of the buyer against sometimes dubious practices of trade or illegal breeding, animal trafficking, various frauds etc. (Ordinance of October 7, 2015). What could be simpler as a breeder than to assume his responsibility if, however, a disease or lack of conformity were detected after the sale and for which the breeder could not be ignored or be held responsible.
The amicable search is always preferable to a legal action which is sometimes heavy to bear and the outcome of which would be uncertain.
The seller undertakes, and limits his liability to the exclusion of any other unplanned expense, to reimburse the full price paid if the cat came and of his own accord todie before their first birthday or suffer from an illness. This will be returned to the seller or may be kept by the buyer if the reimbursement is limited to 50% of the price.
In addition, the buyer can return (without reimbursement) the cat to the seller within 6 months of its birth if it does not suit him as long as his condition is not altered or transformed (supporting tests) and if not spayed / neutered since.
List of documents given to the buyer:
- negative tests for transmissible diseases from the Fiv Felv cattery available on the site (copy on request).
- pedigrees of the parents and their negative HCM PKD tests available on the site (copy on request).
- Veterinary certificate of good health for the kitten.
- The non-exhaustive list of legal guarantees and remedies.
- The vaccination record indicating the vaccines on the day of delivery.
- The identification card.
- A sample of kibble and a toy to ensure the transition.
